Expungement of Criminal Records

People with Olmsted County criminal records have two paths to sealing under Minnesota law. Automatic expungement under Minn. Stat. § 609A.015 applies to dismissed cases, completed diversions, and many convictions after waiting periods from discharge of sentence. The BCA handles the process without any action required from the individual. Waiting periods: two years for misdemeanors, three for gross misdemeanors, and four to five years for eligible felonies. Courts must notify defendants at sentencing if they may qualify later.

Predatory Offender Registry

People convicted of certain serious crimes who reside in Olmsted County must register as predatory offenders under Minn. Stat. § 243.166. Covered offenses include criminal sexual conduct, kidnapping, and related crimes. People who move to Olmsted County or Rochester from other states with qualifying convictions are also required to register. Registrants must provide their current and secondary addresses, employment, vehicle information, and phone numbers to local law enforcement. Annual in-person verification is required, and any address change must be reported within five days.

Before release from confinement, each registrant receives a risk level assessment under Minn. Stat. § 244.052. Level III offenders, assessed as high risk, have their information posted publicly through the Department of Corrections.
